You have to remember that Hicks is fighting from a position of extreme weakness, despite his bravado.

I think he is snookered no matter what trick he tries, there are loads of other factors we havent considered such as getting Premier league approval for any coup he pulls off.

Part of Hicks' strategy if he is considering a sale or refinance with Mill is that RBS buckles and accepts his money. He told the Dallas court this week that he is "aggressively negotatiating with RBS". I found this hilarious because at the same time on the other side of the Atlantic RBS were in court seeking an injunction against him. :D

RBS are in a really difficult position. They want their money back, and appear to have a perfectly legitimate process with NESV whereby they will get that money back. They will be more worried by being sued by NESV for breach of contract than being sued by H&G. On a personal level many of the people within RBS dealing with H&G probably despise them due to the mess they created. They will also have one eye on public opinion within the UK as there will be many unhappy Scousers out there who might do a S*N on the RBS if RBS are seen to make a 50/50 decision in favour of Hicks. All of these are factors but ultimately it'll be NESV and Justice Floyd they will be most scared of, not H&G, and I think that they will probably reject any new refinance or sale.

If the rumours are true that H&G are withdrawing the TRO, this is a major defeat for them. Anybody who read the TRO will know that H&G effectively lied by ommission to the Texan judge. He accepted their arguements in good faith and was blindsided by their skullduggery. I'll wager that the Texan judge sent H&G a message by adjourning the TRO hearing this morning: withdraw the TRO or I'll withdraw it and penalise you heavily for misleading me. This is an option used by judges world wide to allow bold plaintiffs to reconsider their position and withdraw with their tail between their legs under threat of having the book thrown at them if they carry on.

Only the Board can decide who the shares are sold to and the fact remains that the Board is committed to selling to NESV.

Reporter at the court says unconfirmed stories are Hicks has sold his shares to Mill Financial.

Just been on sky sports news that hicks is selling his shares to mill finance and they are try to raise the funds to pay off RBS by the end of play today. the tw@t never gives up.

So, now, time to get down to business. Updates forthcoming.

Update: 6:48 a.m.- Attorney's representing New England Sports Ventures are at the courthouse, and do confirm Hicks and Gillett's attorneys filed at 1:00 this morning a motion to dismiss the temporary restraining order. They still want a hearing in front of the judge in order to confirm the filing, and for the judge to sign the order. Says George Bramlet, the attorney representing NESV, when asked why Hicks and Gillett tossed the TRO: "maybe they thought they weren't going to win, who knows."
There is no-one anywhere in the world at any stage who is any bigger or any better than this football club.

Yes, that is true but I suspect that any post sale litigation would involve Hicks going after RBS and the board.

Ultimately I feel H&G havent a leg to stand on there either but the insurers might decide to settle.
