and bluster and it masks, for now, hick's true intentions hicks wants more money and he knows he can't get in on the open market therefore he wants to sue the directors to say that they sold his asset (shares) at an undervalue in order to do that he has to make a fuss about it at this stage - hence his pretence in sacking the board and making a song and dance about it but neither he nor broughton expect hicks to win that case
of the day and making it clear that he's not happy with what they have done otherwise when he gets into the box to complain about the valuation of the sale in his damages claim the first question he will be asked will be something along the lines of 'well if you thought the sale undervalued the club, why didn't you do anything about it?'

I'll wager anything that Hicks' argument that the undertaking is to sell the club for a reasonable price and he'll argue that the price is not reasonable.
If its very messy the court will likely show some sympathy to the shareholders and could well adjourn the matter for a few months to allow both sides (in reality Hicks) come up with more evidence as to the manner in which the undertaking was given and what it really means.
Ultimately I still feel that MB will win and even if Hicks gets the matter adjourned for more arguement he still has RBS and the 15th Oct. hanging over him. However, Hicks is coming from a very weak bargaining position and will hope that dragging the matter through the courts (even though he's likely to ultimately lose) will give him more breathing space.
But if RBS call in the loan - does it end there as in defaulting on the loan would relinquish any adjournment decision, since he will have broken the terms of his refinancing contract?
So either way he won't win right?
and I bet ya RBS are ready to call it in - now that NEVS are in the scene, that must be the game plan - reveal the hand by the baord, show how numpty these are being.. and sell it to them either way !
