The Premier League set the rules, not MSI. The Premier League won't look stupid, if MSI do not comply with the rules the transfer will not go through, it's as simple as that. MSI do not set the agenda for our transfer rules, the Premier League do. If they do not comply with the rules, it's they who will look stupid.

The Premier League won't fight this. West Ham gave permission and have nothing to complain about.

But have they? The new rules clearly state that West ham have to be apart of any Tevez Transfer.

Man Utd have confirmed they got permission from all parties.

I'm not saying they will, but you suggest that it's the Premier League who should be worried about looking stupid, when it's clearly the other way around. If MSI don't comply with the rules, the transfer will not go ahead.

Ok just to clear this whole thing up once and for all

The deal is complicated because West Ham United do not own Tévez outright, but it is thought that the London club have agreed to hand over the player’s registration rights to United so that the transfer can be sanctioned by the Premier League.

It was unclear last night whether West Ham would receive any payment from United, although privately the club are thought to be glad to see the back of a player, who, through no fault of his own, has caused them considerable embarrassment.

A spokesman for the Premier League said: “As far as the Premier League is concerned, any potential deal for Carlos Tévez must be struck directly with West Ham United.”

Thats one version of events, heres the other

Magnusson said: "I would like to reiterate that Carlos Tevez is a registered West Ham player with a playing contract that still has three years remaining on it and that situation remains unchanged."

Hope that clears it up for everyone !

Not really, and Magnusson hasn't lied. There is a distinction between the economic rights and the registration. He was referring to the registration rights. MSI must have a veto on the registration of the player in their agreement with West Ham.

That was the whole point, but with out my Smiley's its hard to express.

They are both saying different things even now, one is saying he cant talk to any other clubs without our permission, the other is saying we have permission to talk to other clubs.

This whole thing stinks and i am relieved that we are not involved in it

Magnusson didn't say he wasn't allowed to speak with other clubs, he's just being a stubborn bugger to deal with. I think he is p!ssed off about the whole situation, one which is largely beyond their control. I doubt they will kick up a fuss about the registration given the Tevez-Sheffutd "affair", and I hope the sh!t follows Tevez to the mancs. That would be nice, may divert some of the early season pressure off us.

He did say it..Hammers chairman Eggert Magnusson said in a statement: "Carlos Tevez is a registered West Ham player, contracted to the club until June 2010.

"There is no agreement with West Ham for Carlos Tevez to leave the club and we expect him to return in time for next season's preparations.

"No decision on his future can be reached without the agreement of West Ham."

Joorabchian responded to Magnusson's statement by confirming he HAD been given permission by West Ham to hold discussions with other clubs.

"We confirm that Carlos Tevez has, with the knowledge and permission of West Ham United Football Club, been in discussions with other clubs.

Thats why it becomes confusing, he is either a West Ham player who will be there next season, or he is a West Ham player who has been given permission to talk to other clubs ?

He didn't say it! He said permission was required from West Ham!

Now he has been allegedly given permission he can speak with other clubs. But in reality, his representatives will have been communicating in one way or another with other clubs anyway.

Magnusson is probably just being a stubborn fecker, aware of the fact that ultimately they may have no say in whether he leaves or not.

Its the same thing, it may look like he is being stubborn but the Premier League have already said they will be watching the situation closely and   "As far as we are concerned any deal to take Carlos Tevez away from West Ham has to be done directly with the club."

The Premier League have demanded that any transfer is handled by the Hammers and will block the move unless they are satisfied the transfer fee will go to West Ham.

The league accepted in April that West Ham had terminated all agreements with Tevez's agent Kia Joorabchian - and will keep a watchful eye on any transfer to ensure that the club keep their promise.

So if Magnusson expects him to resume training with West Ham next season like he said, then he obviously hasn't given permission for other clubs to talk to him, therefore Joorabchian is going to find himself in a lot of trouble if he is trying to negotiate a deal without Magnusson's say so ?

You can read what you like into it, but he didn't say Tevez was not allowed to speak with other clubs. He said what every chairman would say, permission is required first. Referring to pre-season training, he is saying as it stands Tevez will be reporting back, but things change.
Magnusson may have his hands tied, he says permission is required and Joorabchian says permission has been given. I'm sure there is a mis-communication somewhere. Either that or Magnusson is playing hardball. Since we don't know the exact agreement we cannot really speculate too much. The agreement may be worked out in a way that complies with the Premier League rules, there are many ways in which slight of hand can alter the paperwork to meet Premier League guidlines. Joorabchian has top lawyers for a reason.

I think the Mascherano deal sets a precedent, if that transfer was ratified I see no reason why the Tevez transfer shouldn't be.
