Hammers escape points loss

West Ham have been hit with a huge fine by the Premier League following the hearing into the transfers of Carlos Tevez and Javier Mascherano, but have escaped a points deduction.

The Premier League opted to look into last summer's transfer of the duo after doubts emerged over the ownership of the pair.

The case centred on the issue of third-party ownership of the two players, who were signed from Corinthians, and also the club's failure to disclose details of the deals.

A points penalty could have been imposed, but a Premier League panel comprising of Simon Bourne-Arton QC, Lord Herman Ouseley and David Dent opted to mete out a financial sanction.

The panel opted to hand down a £5.5million fine, but West Ham have escaped a points deduction and can now focus on their battle to avoid relegation from the Premiership. 

West Ham issued a statement responding to the verdict on their website, which read: "West Ham United Football Club was given an opportunity to present its case and received a fair hearing.

"The club's submission that the contracts gave no actual influence to any third party was accepted by the commission.

"The club has not been found guilty of fielding an unregistered player and speculation about a likely points deduction has proved to be unfounded.

"The club regrets the fact that they fell foul of the FA Premier League regulations, but the new owners of the club now want to focus on matters on the pitch and remaining in the Premiership.

"The threat of a points deduction has now been removed and the club's fate remains in its own hands.

"The club believes that promotion and relegation issues should be decided on the pitch and we are pleased that the commission agree with that view.

"The club will reflect on the financial penalty that has been imposed and will take advice before commenting on the possibility of an appeal or any further steps that might be taken."

West Ham face Wigan on Saturday and it remains to be seen if Tevez travels to The JJB, as the hearing report also said 'the registration of Carlos Tevez can be terminated' by the Premier League.

Three points:
1. What happens to the 5.5 million? does the FA keep it or is it divided amongst the premiership clubs who have suffered as a result of this illegal action. If the FA keep it, what will they do with it if they refuse to invest in national training facilities?
2. If this had been passed down at the beginning of the season they would have deducted points. Not to deduct points just because they are fighting relegation is pure bias.
3. Surely they'll have to sell Tavez to pay the fine?

Last, 5.5 million is a REAL fine. So why were lens, Roma and Man Utd fined such pathetic amounts for crowd violence, the biggest threat to our game?

The fine seems fair enough as obviously the cost of relegation to the other clubs would be far more.
But why can they get fined 5.5 million and then clubs that have racism going on get sh!tty 100,000 fines or even less ?
The F.A or Uefa are showing where there priorities lie, and its not stamping racism out as they keep saying !

Tevez cannot play for west ham again unless they buy all ownership of him from the Kia guy.

How good was he last night though!? absolutely immense performance. Fair play to the lad, he's obviosuly got a great attitude as despite all the sh!te he's had to put up with he's giving his all for a side struggling to survive.

Rafa should go all out to get him in the summer, he's the sort of player we need.

Agreed.
Can't give you his pro's and con's but i like his attitude and what little i have seen of him recently he's looked very good.

agreed mate...

  he is one hell of a player  so strong in build he does remind you of maradona a bit with his strong build...

not sure if he will be on rafa's wish list...   

only time will tell,  he wont come cheap...   :;):

Yeah, we'll sign him.

Six million sounds about right, which includes the cost of fixing his teeth and paying the church of Notre Dame for the expense of them having to find a new bell-ringer to replace Tevez.
