Tom Hicks and the Royal Bank of Scotland to resume legal dispute over sale of Liverpool in High Court

Former Liverpool owner Tom Hicks and the Royal Bank of Scotland will resume their dispute over the club’s sale to New England Sports Ventures in the High Court on Wednesday.

Both parties are seeking a series of injunctions stemming from the bitter court-room battle last October that ended with the club being sold against Hicks’s wishes in what he dubbed “an epic swindle”.

That process saw legal action filed in Texas as well as London, and the High Court will be asked to deal with unfinished business started in that frantic week of litigation.

If Hicks is successful in court it could clear the way for a series of damages claims against the bank and the former club directors.

RBS is understood to be seeking to permanently block Hicks and his former partner George Gillett from suing for damages following the £300m sale of Liverpool.

Justice Christopher Floyd issued an injunction ordering Hicks to drop the Texas action and RBS will seek to have that made permanent. The Americans meanwhile will apply to have the injunction varied or removed so they are free to pursue the bank for damages


The pair lost around £140m on the deal, and Hicks’s US lawyers have said they intend to seek hundreds of millions of pounds in damages by way of redress.

Former Club chairman Martin Broughton is also seeking protection from any damages claim from Hicks. He will ask the court to grant “negative declaratory order” which effectively means he has no liability on any claim from the Americans.

NESV is also seeking to be joined to the Broughton action so that it too is immune from future legal action in the US. Both will ask the judge to order that any action that is brought by the Americans will have to be heard in the UK courts rather than in Texas.

The hearing is listed to last three days.

i was wondering what rock they were hiding under for the last while.:laugh:
lets hope floyd kicks em back to the kerb where they belong after all it was them who was swindlers of epic proportions.
to add i hope rbs end up suing them and take another £140 mil out of there pockets:laugh:

spot on. They had no case last year when they attempted to block the sale and they have no case now either. It's a desperate move from a pair of desperate businessmen. All that will happen is they'll lose yet more money in legal fees and get told to f**k off again by UK courts.

I've wondered to what extent the new owners will commit funds for the new stadium and nett transfer funds until they fully know the extent of their liabilities. Folks in the media have been asking why they've been so slow, well here's the answer.

Anyway, its a great opportunity for Lakes to start bs'ing again!....... The Sequel !!  :laugh:

thing is, both H&G NEED to win this court case, otherwise they're ruined  :laugh:

lets not be too complacent, who knows they might spring a surprise. there is no reason for them to go to court unless they believe they have a chance to win anyway. but most importantly, hopefully this sequel doesnt effect the players especially when we're on such a good run.
